Visa is a document issued by a competent authority of Vietnam, allowing foreigners to enter Vietnam.
According to Article 8 of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014, amended in 2019, visas include 21 types.
In which, visas for foreigners to work in Vietnam have the following types and symbols:
- Symbol: DT1 – Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with contributed capital of 100 billion VND or more or investing in priority industries or trades investment incentives and investment incentive areas shall be decided by the Government.
- Sign: DT2 – Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with capital contribution from 50 billion VND to less than 100 billion VND or investing in the industry The profession of investment promotion and development shall be decided by the Government.
- Symbol: DT3 – Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with contributed capital from 03 billion VND to less than 50 billion VND.
- Symbol: DT4 – Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a contributed capital of less than VND 03 billion.
- Symbol: DN1 – Issued to foreigners working with enterprises and other organizations with legal status in accordance with Vietnamese law.
- Symbol DN2 – Issued to foreigners to offer services, establish a commercial presence, and perform other activities under international treaties to which Vietnam is a contracting party.
- Symbol NN1 – Issued to persons who are heads of representative offices and projects of international organizations and foreign non-governmental organizations in Vietnam.
- Symbol NN2 – Issued to heads of representative offices, branches of foreign traders, representative offices of foreign economic, cultural and other professional organizations in Vietnam.
- Symbol NN3 – Issued to people entering to work with foreign non-governmental organizations, representative offices, branches of foreign traders, representative offices of economic, cultural and professional organizations other foreigners in Vietnam.
- Symbol LD1 – Issued to foreigners working in Vietnam with certification that they are not eligible for work permits, unless otherwise provided for in an international treaty to which Vietnam is a contracting party.
- Symbol LD2 – Issued to foreigners working in Vietnam who are required to have a work permit.
Pursuant to Article 10 of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014, amended in 2019, the conditions for being granted a working visa in Vietnam include:
- Have a passport or valid international travel documents
- There are agencies, organizations and individuals in Vietnam to invite or guarantee, except for some cases as prescribed by law
- Not falling into the cases that have not been allowed to enter the country as prescribed by law
- Having papers proving the purpose of entry: papers proving the investment in Vietnam according to the provisions of the Investment Law or a work permit according to the provisions of the Labor Code
Pursuant to Clauses 4, 5, 5a, 6, Article 4 of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014, as amended in 2019, the duration of the above visas:
- Visas with symbols DT4, DN1, DN2, NN1, NN2, NN3 are valid for no more than 12 months.
- Visas with symbols LD1, LD2 are valid for no more than 02 years.
- The DT3 visa is valid for no more than 03 years.
- Visas with symbols DT1, DT2 are valid for no more than 05 years.
